Terms & Conditions of Service

We all have to do it, it protects you, it protects us. We are here to make you happy as a customer but as you can appreciate there are some rules to help us help you... so here it is, the legal stuff, the small print:

You agree

You must agree to all, including terms that may not be enclosed directly here. By using our service you agree to abide by the terms of service noted here.

We will not allow you, the customer, to host anything which is illegal, dangerous, violates any laws or causes any concern/complaint from viewers or authorities. The hosting/e-mail shall not be used for spreading threats, hoaxes, viruses, infecting computers, causing damage to our servers.

The service shall not be used for P2P file sharing or transfer of copyrighted material.

We reserve the right to cancel any account at any time, without prior notice - and data on your webspace and e-mail could be deleted without notice should be detect unlawful activity.

Fair Use

We don't restrict you on our unlimited hosting packages, however we still have to ensure everyone gets a great level of service. If you use an excessive amount of bandwidth we may contact you to discuss your requirements.

Excessive bandwidth usage will result in a disabled account status, or an increased cost - in the worst case, your account could be suspended or removed. This excessive bandwidth usage will only be if you are leaching the bandwidth from other users. We use methods to restrict the performance of heavy bandwidth websites, therefore you will not obtain optimum performance. This only happens in serious cases where our bandwidth provider notifys us of excessive bandwidth use.

A home series package may not be used for business, you must use a business package.

Security

We monitor all accounts, traffic and servers 24/7 and will block any unwanted activity. Suspicious traffic will be investigated, regardless. The data you send/receive to our server is logged so we can provide a secure webhosting environment to our users - this also ensures uptime and performance.

We must state, that security is something we take seriously. Everything is monitored. We will deal with anyone attempting to damage or cause a problem to our service. If we suspect an account has been hacked, we may suspend the account and investigate the issue.

You must not copy a copyrighted website from another author, or use any form of fake websites used in typical phishing attacks.

It is an offence to cause disruption to our network or that of our conectivity providers.

Uptime

Although we do our very best to hold a 99% uptime, we cannot avoid natural causes or unforseen issues at your end or that of our provider. We operate backup systems to avoid these issues, but occasionally there could be issues that are out of our control. We can only guarantee against issues that have been due to our systems. Connectivity issues or mains supply issues that may cause issues that cannot be avoided and therefore are not in our money-back guarantee - unless the fault causes serious disruption for more than 12 hours. We must also make allowances for system upgrades, therefore we will do our best to notify you of possible outages beforehand. Outages on business class services are taken with priority and we will do our very best to keep a very competitive uptime, with the allowance of system upgrades.

Spam

We do not tollerate a user sending spam from an account, it is unlawful in the UK and will be dealt with by the local authorities. Do not attempt to abuse the e-mail system, if we obtain a complaint we will contact you to discuss your e-mail requirements. If the mail traffic is unauthorised we may ask you to leave.

We reserve the right to remove a feature of your hosting package at any time for any reason - though we will notify you why this has happened and how long for.

Data ensurity

Account data is not ensured at any time, please make regular backups. Again, we do our best to have backups and have backups of backups.

We do our very best to keep your account safe at all times, and you should also keep your account details safe to ensure unauthorised users cannot gain access to your account.

YOU MUST backup all data regularly. Although our server has backups, if this failed or was deleted - we have no means of recovering. We hold NO responsibility for loss of data.

Performance

We cannot ensure speed at all times, due to problems with our network carrier or excessive use. Speed is throttled and controlled via our network in serious cases. Most shared hosting platforms are offered a low upstream speed to ensure everyone gets a good share of the bandwidth, while premium or business account holders will gain higher bandwidth.

Content

It is your responsibility for the data on your website, legally and technically. You will not host anything of illicit content, or X-rated material unless it complies with all UK and EU law - do not distribute this content through our network. This includes using the service to promote things of an unlawful nature.

Billing

Payments must be received promptly or service will be suspended. If no payment is received after 10 days, without prior arrangement, the account may be deleted or suspended depending on the conditions.

We reserve the right to charge disconnection fee's if the customer decides to end the contract, before the contract ends.

Other clauses

The general rule is not to abuse our service. We are here to provide a service to our customers, and we are happy to provide the best service we can. If you treat us right as your ISP, we'll be happy to take care of you...
